Only 3 of 5 documents submitted to court. how to force submission of remaning?

IA was filed to produce 5 documents under o11r14 but only 3 were submitted to Court and 2 have not been submitted. Should fresh IA be filed for remaining 2 documents or is there some other way?

If only three documents filed and two more documents mentioned in the list have not been filed then the court will ask the petitioner to cancel the entries of unavailable documents.

The Court has already considered application u/o XI Rule 14 CPC and directed to produce all the documents in the power and possession of respondent (in IA).

If the respondent did not file 2 out of 5 documents as directed, the court shall draw inference accordingly and there is no need to file another IA.

The proiblem is the Court is silent about the remaining documents so its not clear if Court has taken note of these documents notbeing submitted or it is oversight and we need to remind Court of this fact.

The daily order just notes documents submitted with memo.Nothing about documents not submitted or abt hearing on the IA

Should'nt the Court explicitly state something about the documents that were not submitted? Also, should'nt there be a hearing about this?

Let your lawyer may submit your view on the subject to the Court, if you feel so strong.

So should we file a memo abt the remaning documents just so we are sure Court silence is not due to oversight?

The court will hear your grievances or objection only during the date of hearing, the court is not silent about this, when the oppoiste party has submitted the entire documents but furnished only a few documents to you then you have rights  to ask about the remaining to the court in case they refuse to furnish the same to you.

You cannot ask for the documents that have not been filed in the court

With application u/s 151 cpc file documents and seek permission to exhibit.

The facts posted are less than convincing. If any documents, as directed, are not produced, the said party is required to inform the reasons through affidavit.

What is the Case No.? Which Court?

It turns out Court was not aware 3 documents were no tsubmitted and now a hearing has been scheduled about the same
