One single agreement covering lease as well as leave and licence

We are entering a flat tenancy agreement with Bangalore landlord ,where headline is LEASE AGREEMENT but inside also mentions LEAVE & LICENSE AGREEMENT. we will require for 2 years but landlord cum Lessor gives 11 months followed by renewal window. Is it not defective as both Agreements work in different platforms. Ambiguity prevail. Please guide

It is perfect. 

Any rent /lease agreement /leave and licence for one year or above has to be compulsorily registered, however, less than one year may be regitered or notary attested, it is admissible in evidence.

Can we mention both the  LEASE  AGREEMENT AS WELL AS LEAVE & LICENSE AGREEMENT. 

Both operate in distinctively separate perspective

Any suggestion depends upon the tenor of the agreement. Mere nomenclature may not be decisive. Incase of ambiguity the real test would be the tenor of the agreement.

It is for 2 years for our foreigners consultant. But Bangalore based Landowner is making 11 months contract, subject to another extension of 11 months to protect his interest

Even beyond 2 months rents equivalent security deposit as per New Rent Code. He is taking 7 months 

We do.not have any choice.

Get the Leave & Licence of 11 months executed and subsequently extended as desired by landlord on mututally agreed terms of conditions of the agreement.

If you are not satisfied then you can ask the landlord to amend the title from lease agreement to leave and license agreement.

It is not an hypothetical question. It is a real issue. Going by the suggestion in earlier trail, we have requested landlord to Amend it, which he agreed.

Trust no ambiguity is there.This platform is sourced by eminent rich knowledgeable faculty. Hence, we raise real queries.Many Advocates and CAs in practice are not that upto the mark- people all know.
