Just because you are staying away from your husband you cannot file a divorce case against him that too you want exparte decree of divorce (?), what if he challenges your case?

Divorce can be granted on some specific grounds like cruelty by the other party, desertion of the other party without proper reason, mental illness, adultery etc. If you have no such ground or you have such other ground which cannot get you divorce, then sit with your husband and after his consent file a mutual consent divorce on the ground of tempermental differences.
