On death of a complainant in Private Complaint

 

Plot owners formed an association and given GPA to its secretary to file a private complaint before a Metropolitan 1st class Magistrate regarding their plots purchased on behalf of their association against a Real Estates Construction Firm. The Hon’ble Court referred the matter to concern P.S to investigate into the matter. As usually the concern P.S submitted their final report before the Hon’ble Court stating that the matter is in civil in nature. Complainant on behalf of the plot owners association filed protest petition and prosecuted the case. Meanwhile the present complainant who was a GPA holder of Plot owners association died with severe Heart Attack recently when the case is in pending. How the case shall be prosecuted? What steps be taken to add a new GPA holder to prosecute the pending case? Procedure with sections in Cr.P.C please?

Sir, call for the association meeting and pass resolution to appoint as a new power of attorny for select person then produce the memorandam of new GPA before the court that"s all.

In a private complaint the legal hairs also prosecuted the case.
