Notice u/s 80 cpc

Hi,

 

Mother-In-Law filed case against the wife (whi filed 498A case). Police investigated case of MIL and filed final report saying that allegations are flase. Police refused to share the evidence that provide information that allegations are flase. Also polise failed to collect the documents listed in complaint in support of the allegations which provide information that allegations are true but police refused to collect them and still said that complaint is flase.

 

 

Does notice U/s 80 of CPC is applicable to the police to rectify the errors in final report after withdrawing the final report from court.

 

 

Does notice U/s 80 of CPC is advisable ....

 

 

Any other advice may be suggested.

It is a criminal case, CPC has no role.

Can any body advice e what is the appropriate action that MIL can take action against the police on their malpractice....

 

In the website of RTI India. org, people say that RTI applicant can file suit against the police upon refusing to supply information under right to information act, 2005.... does it possible? In this case, what could be the relief that applicant can seek for?

sec 80of CPC is mendetory in the matter of Civil litigation against the State no need in Criminal Matters

You can move court u/s 156(3) CrPC r/w 200CrPC.
