Non occupancy charges

I am a resident of Mumbai.I have given my flat on leave & licence. The Society is charging me 10% non occupancy charges on the total monthly maintenance bill less the property tax. I have objected to this saying the non-occupancy charges should be levied only on the services offered by the society. This means Sinking fund; Repairs & Maintenace charges; electricity bills and water charges should also be excluded while calculating the non-occupancy charges. Kindly let me know if I am correct in my arguments. Is there any notification or any clause in the MSCoop Act which stipulates how the non-occupancy charges should be calculated? If there is no clear directive in the Act or Bye-Laws then I personally feel the forum should file a PIL to clarify the matter. Number of Societies in Mumbai are facing this problem.
