Nominee-Legal Heir-Insurance Claim -Reg

Dear Members,

A-husband took a policy on his life and nominated his Mother-M as nominee. After the death of A, the nominee claimed the policy amount, meantime, his Wife also claimed the claim vide legal notice to the Insurance Company claiming that, being a wife she is only entitled to recieve the policy amount as per Hindu Succession Act. In this situation, whether the Company can release the amount to the Nominee or to the Wife of deceased policy holder or to ask for both the parties to obtain a Succession Certificate for the release of the amount.

Please clarify the above doubts at the earliest.

 nominee of the policy alone is not entitled to the entire amount.The nominee is only a executor i.e she must distribute the amount to all the legal heirs of the deceased.it is better to ask the parties to produce succession certificate.

The    most     appropriate    solution    would   be   to    ask   for  succession    certificate    by    the     parties.
