This is in the case of Home Loan from Bank for resale Property.
The property is resale one and its located in apartment, wherein, builder has conveyed the land in favour of apartment by way of Declaration also, Deed of Apartment has been executed. Can the bank insist for NOC from Apartment as condition to get a home loan? Please indicate if any provision under Maharshtra Ownership Act / Case laws is available.
