New allegation stated during trail by wife

Hi All,

 

During 498A trail, if wife raises any NEW ALLEGATION or NEW INCIDENT, that is not stated in either complaint or in CrPC-161 statement what to do? Also comment on below:

 

  1. There is no need to cross examine wife with respect to the new allegations stated by wife during evidene stage in 498A trail.
  2. Wife should be asked the below questions:

              2.1 It is newly created now and is not stated earlier anywhere.

             2.2 None of the law witnesses also never stated this incident hence it is fabricated now.

I under stood that Improvements are not allowed means, omplainant can not say more than what was said earlier....

Even if complianant adds any new incident/allegation that would be considered as proof less and is considered as ommission and contradiction as per CrPC-161 and 162 sections.
