Negligence by hospital staff

A lady gets admitted to emergency ward at 2.30 p.m. due to accidental fall and fracture in arm. Doctors attend her in time  and get her admitted  as inpatient for operation fixed for the next day.  Same time they prescibe medicines to be given to her by 5 p.m  and the ward nurses send the presciption to thier own pharmacy for procurement of the medicine  as they do not alllow patinet to get the medicinne directly. The patient complains to two of the nurses about her pain in the arm and requests for the medicine. She also  request to the duty doctor in the ward for the same as the nurses do not respons for about 2.5 hours  after whihc new team of nurses change duty. The new team of nurses were also requested for medicine for the pain in the arm by the patient. But no response from them and the suffering continues till 10 p.m in the night .At this point to time husband of the patient makes enquiry nad finds out that that there is no co -ordination between nurses and the pharmacy . He also gets evasive reply from nurses. But as he continues the pressure on them with questions, they apologise and  rushingly et the medicine to be given to the pateient after 10 p.m with the lapse of over 5 hours  of presciption. Now the question is if the staff nurses,  pharmacy within are responsible  under law for the negligence and sufferings.

Bring to the notice of Hospital suptd and if no action is taken issue legal notice and file case in consumer forum for damages.

Failure on the part of Government hospital to provide timely medical treatment to a patient in need of such treatment amoounts to violation of the right to life. Supreme court Judgement  Paschim Banga Khet Mazdoor Samity V. State of Wst Bengal,  reported (1996) 4 SCC 37.

A email was sent to the Medical Superintendent  and a reply letter  was got delivered by him to me through Nursing superintendent by regretting for the failures with assurance to take action. But steps taken by him are not known. I think  a suit for damages/sufferings may make these staff alert and efficient in future.

Thanks for the reply. This hospital is a very famous private hospital in coastal Karnataka. Do you think the case may apply here also.

Issue legal notice through lawyer for damages and filecomplaint before Consumer forum or State Commission as per your claim.  There are cases filed against famouns hospitals in India claiming damages for the negligence of service rendered to the patients.
