Need divorce from nri husband

This is for my sister. We are residing in India and her husband in Bahrain with his family. She was in Behrain for 2 years. It has been 2 years after their marriage. We came to know that he has s*xual problems. We doubt it is impotency. My sister never had s*xual intercourse with him till date. First we thought it will be alright as time passes and once they understand each other, but we came to know he has s*xual problem as they were sent to counseling.Though we have asked his parents to take them to counseling long before, they never listened,Only after our serious compulsion they took him to couselling. Between these problems my sister had to experience serious torture from his family.her Father in law s*xually torture her by asking what they did last night. Not only that he will try to cuddle and kiss her. When counselor refd a urologist. They consulted the doctor without taking my sister with him. As they found the mistake is in their part they began to avoid her. Nobody talked to her for last few months. She was a teacher in a School in behrain. The account she had was a joint account, but they posessed her card. They also transfered about 5lakh ruppees from her without her knowledge. We are totally fed up by now. So we have decided to move for divorce. 1) If we are moving legally without mutual consent, how long will it take? 2)What if they didnt attend the court and how long they can prolong the case like that? 3)What can we do to avoid long prolongings? 4)If they prove he is not impotent, what can we do for getting divorce?

Hi  iam agree with ram sir if you have prof of docter treatement and you show it in court than you no need to file mutul divorce pition

you got divorce on this ground and also you file case in section 498a for s*xual harrassment and mentally torture

you got divorce and if your husband not atend court after sent to him notice court will give you exparty divorce

1) contested divorce may take 4-5 years.2) if her husband dnt attend it will become exparty.3) court procedure is long.4) if you have some medical proof then only file divorce on impotent ground. Otherwise file divorce on cruelty.

All of the above averments, constitute ground for not only cruelty, buyt also nullity of marriage, as the material fact of his s*xual issues was concealed from your sister by her husband.

FIle a case immediately. In matrimonial proceedings, delay is the biggest issue which can stand in your way . But prompt action can go a long way in helping your case.

You are saying that they never consummated the marriage. You may go for annullment of marriage. It will take shortest. it is better if he doesnt attend as it will take less time then.

To  prove impotense is not easy and so is the other harrassments you have detailed.

Still getting divorce will be easy on so many other factors. Pl contact by email for proper guidance.

No matter how difficult it is swallow, all previous actions should be condoned and MCD should be pursued, if available. Don't let future be condemed by past.

For more detail view on MCD procedure , please refer my reply on another thread
