Need clarification please

Dear Friends

A Hospital registered under the Societies registration Act is running for more than 20 yrs. is not filed any thing under shops and establishment Act.

Kindly advise whether we hv to register ourselves under shop Act or not.

Whether the shop Act is applicable to the instituion or not.. What leave pattern to be followed,

The Shops and Commercial Establishment Act is state subject and The Shops and Commercial Establishment Inspectorate of your state can advise you on applicability and exemptions. Usually the Labor Inspector is also Inspector appointed under this Act... If covered the leave pattern as in the Act may be followed. The Inspector can clarify it also.

Hospital fall under the purview of Shop Act, however automatically exempted from certain provision of the act like opening closing time, shift working etc. Refer schedule to Delhi shop act.
