NC in local police station

Hi Experts,

This is regarding significance of NC in criminal proceedings.

1. In Aug '09 i lodged an NC against my society chairman for abusive treatment against my friends and relatives.

2. In october 09, i registered another hand return complaint in local police station against his intimidation.

3. In Jan 2010,i took help of local gram panchayat people to resolve the issue,but now he alongwith his committee complained (lodged an NC) against me accusing me of intimidation.

Question:

1. In case, i file a case of criminal intimidation,how strong would be my case.

2. Can same case be filed against me to counter mine.

3. When and under what circumstances ,i can file a case of criminal intimidation.

4. Are my previous 2 complaints enough for filing a case or should i approach higher police officials.

What you can do, the other person can do better. To reduce the number of cases (read FIRs), police normally records NC to satisfy the complainant who thinks by this action he has conquered the Mount Everest. In practice, nothing happens. At the most and if some notes have changed hands, the police will call the opposite party, take his statement, warn him and then let him go.

Criminal intimidation won't hold water. Police gets slightly interested only when there is assault, rape, murder, dacoity, riots between two communities, kidnapping.

Yes, there are brokers and touts in cahoots with police who can help you. But, you will have to shell out money.

IF WIFE LODGED NC AGAINST ME FOR SOME DISPUTE,SO POLICE HAVE RIGHT TO BEAT WITHOUT

ASKING OR PROPER INVETIGATION.IF THEY DONE WHAT ACTION I CAN TAKE AGAINST THEM .AT THE SAME TIME FORCE ME TO SIGN A PAPER WITHOUT SHOWING ME WHAT THEY HAVE WRITTEN.HELP ME WHAT SHOULD I DO FOR MY SAFTEY IN FUTURE.WHEN I ASKED FOR THE COPY WHICH I SIGNED, THEY SAID NOTHING WRITTEN ON THAT WHICH HARM TO YOU & REFUSED.
