Name to be added in fathers property

I wish to add my name in a property I.e a house and it is on my father's name. Now I wish to add my name in the legal documents. I have a young brother also, but he will allow me for this. So what is the procedure for that? thanks

Dear sir,

Your father can transfer 50 % share in the property by way of gift deed to you.

in lifetime of your father your name cannot be entered in any legal documents of your father property.Your father is free to dispose his property.

my mother is no more, my brother is in america and he has no problem with transferring this yo me. but how this procedure of gifting me the house will be done and is which legal procedure my father had to do?

1. IF property was self-acquired with his own funds by Father, THEN Father can execute a Registered Gift Deed for pre-determined share ratio of property that he wishes to give it you.
In Maharashtra:  Stamp Duty: 500/- & Registration Fees: 200/-

2. A Consent Affidavit by Brother perpetually releasing his rights on Father's property and such affidavit must be duly attested by consulate /embassy, can be annexed with the Gift Deed, to avoid any futurisitc legal disputes /claims /rights /whatever ....
