Ramesh (Pvt serbice)     26 January 2024

Name change

I had purchased flat in my name as  B R  Ramesh .now my name as  per aadhar and pan is  Ramesh  rajeshrao bellur . As my sale deed and index2 shows my old name  I want to know will I face any problem while selling the flat .if yes what should I do to make document in order so that I can sell the property without any legal issues.

Quick Summary
If you've changed your name since purchasing a property, you might encounter issues when selling. The sale deed and index2 will show your old name, while your Aadhaar and PAN cards display your new name. To sell without legal complications, you can either request a rectification deed to officially update the documents or create a notarised affidavit. This affidavit, along with a newspaper publication stating both names refer to the same person, can be annexed to the sale deed to clarify the title.

You request the seller to rectify your name.

You have changed your name after execution / registration of Sale Deed, accordingly a rectification deed is required to be registered to substitute "new" name.

You can create an affidavit duly notarized followed by newspaper publication stating both the names are one and the same and annex these documentary evidences to the sale deed which will be sufficient to establish the title and clarify the name issue as well.

Rectification can be done only if there was an error at the time of purchase of the property.
