My step father has cheated my mom and took her property in his name
I am a 24 year old boy working at a MNC and studying as well in distance at my own expense , my salary is around 3000₹ and living at delhi by which I hardly save ₹5000 after all house and education expense , even my semester is paused due to non payment.
When I was born in 1997 my father died few months before my birth , I have his death certificate , his voter card , and my birth certificate has his name.
After 10 years my mother got married to someone else because she could not afford my school expenses and that man ( my step father ) agreed to give my all expenses and gave a house in my mother name and told my mother that your son could have his share in the house and live like his own son.
Things were all good , from class 6 to 10 to 12th to college I have my step father name , including my Aadhar, PAN Card , voter I’d card, and passport also, he ( step father ) even went to passport verification with me . Apart from my birth credit certificate everything has his name .
I have some lands in village where it’s in my name which was given by my grandfather ( from my biological father side ) but my uncle ( biological father brother ) is currently taking care of it and not giving any share of it and giving me threat of several damages including my life.
When I got In 12th class my step father stopped giving me expenses and I had to bear everything at my own cost , when I used to come at vacation I used to live with my mom and still doing the same.
Few years ago my step father emotionally blackmailed my mom that he is in debt and will hang himself if he don’t come out of this issue , in fear of losing someone , my mother sold her entire house to save him and step father promised that he will give the new house in her name ( ofcourse a cheaper one and less than the amount the old house ) but later we came to know he has the new house in his name and cheated my mom , a wife who sold her entire house just for the sake of saving him .
We did nothing by thinking let it be , because I had no interest in living at his house until I will have my own house ( when I will buy a new one by my own money ).
My mother and step father had a baby girl ( my sister ) she is now 5 years old , after holding many meetings with locals and leaders he finally agreed to give the half house in the baby girl name and half in his name , so the output was my mom got nothing.
Since last 2 years I am living at the new house because of pandemic and working from home , I am managing the house expense since last 2 years , including I bought fridge inverter AC but still I didn’t have any intention to live permanently at the house.
Since last one month he is doing character assassination of my mother and saying bad things about me and asking my mom to tell me to leave the house , he even instructed some goons to call my mom and threatened to tell me to leave the house.
He is now living at his second wife house which is way expensive and more than what my mother have.
Logically when he was asked to give at least the expense for my mom and his little daughter but he denied , I am looking after my mom and little sister now and he is still continuing to threaten me and my mom.
So the question is when he married my mom he told my mother to look after me also and I can live in the house in that condition my mother got married to him.
My mother don’t have any proof of that condition , but I have his name in school, college’s, pan adhar, passport including where I work.
So my own uncle ( biological father brother ) and step father have become friends and planned to throw me out of the house , so he can freely use my land because I will be out of this town and my step father can be happy and violence my mother at his own choice.
So the thing my mother don’t want to leave me because he is scared of him , can I claim the property rights from my step father because everything I have in his name? If not , can my mother get back what she sold for her husband ? If not , my mother wants a divorce because of his bad behaviour and violence, and what rights my mom have interns of property and the all cheating he has done ?
Please don’t tell us to solve the matter by family because we are enough of him. And we belong from a Muslim family
