My office has refused to add my child as medical dependent

You get a declaration in the form of an affidavit affirmed by your wife that she is not availing this medical insurance covered by her company and then you submit it along with your application to the AAI requesting to add your child as your dependent for medical benefits.

If they still insist on the declaration to be made by your wife's employer then you can issue a legal notice through your lawyer demanding the prescribed provisions of law mandating the said requirement.

If there's no proper response you can approach high court with a writ petition seeking direction to AAI to accommodate your request by an order of court.

Both of you are entitled for medical facility, as per policy of the employer(s). Accordingly, either of you can avail medical facility for the baby, which can be claimed as per your choice/ convenience.

If you (either of the claimant) is/are denied the facility issue legal notice to your/ her employer.
