Mutation procedure for legal heirs in andhra pradesh from a deceased parent.

Dear Sirs,

A property stands in our mother's name. She died intestate regarding that property. 

We have legal heirs certificate and death certificate of our parents. All the siblings reside in different cities of India and one of the heirs is a US citizen living in the US and with no Indian idenitty proof except his old Indian passport and his present US passport that state the names of his parents. The rest of the siblings are willing to give me GPA/SPA for carrying out the mutation procedure on their behalf. The local document writer says that my US brother needs to get an Aadhaar card first, while our legal advisor from another city says there is no need for Aadhaar for my US brother.

What should be the procedure we should follow in sequence? Kindly clarify.

Here's a possible sequence: - Get an NOC (No Objection Certificate) or GPA/SPA from your siblings in India. - For your US brother, he might need to get his documents attested/ authenticated (like US passport, old Indian passport, and other supporting docs) for Indian authorities. - 

Check with the local land registry/ mutation office in Andhra Pradesh for specific requirements - they might accept his US passport and other docs .

The document writer is not updated in this regard.

The identity proof may be his passport even if it is US passport but having his parents name in it. 

You can obtain SPA from your US brother too along with other brothers and proceed with the mutation and other further works in this regard on behalf of you and on behalf of all others too.

I endorse the opinion and  advise of learned senior experts. Your brother residing in US has to execute and submit attorney in your favour duly attested.
