Minimum members required to form MC of apartment association

Dear Sir. What is the minimum number of members needed to form managing committee of an apartment association? Our bye-laws state 5 members are required to be in MC. Unfortunately, we are able to convince only 4 to become office bearers. Can a resolution be passed in AGM to render one of the posts redundant (such as vice president)? Our apartment association in Bangalore is registered under societies registration act. Best wishes.

You can refer to the Registered Bye-laws of the Society to find out the strength of Managing Commitee.

What is the total number of members in your association? You hold election. Call for nominations. If the number of nominations received are more than 5, conduct elections. If the number received are 5 or less declare all the candidates elected unopposed. If the number of nominations are less than 5, do as follows. Call a general meeting. At the meeting call for volunteers to come forward and co-opt them as members of MC. You will be able to get one or two to remain at least as dummy members. This suggestion is based on the assumption that you are not a co-operative society in Maharashtra. In Maharashtra you have Tuglakian laws.
