mhcs act

Dear learned advocates

we are residents of A and B bldgs in our society
1. Earlier leakage repair work carried out was low budget grouting work carried out in patches. This however has got partial success, but not resolved the leakage issue fully
2. In case leakage work needs to be resolved long term, need to remove podium level tiles and create concrete layer to stop leakage
3. This is high budget work, coming to approximately Rs. 20 lakh per building
4. Utilising available funds with society (in proportion to A and B bldg. funds), society shall pay 50% of above amount, with 50% contribution from residents
5. This should come to approx. Rs. 25k per flat, spread over a year approx. Rs. 2000 per month
6. MC shall review additional quotes, and negotiate to settle with final amount
7. MC welcomed residents from A and B bldg. to bring forward known contractors, who can also provide additional quotes, and also be part of the review process
8. Mr. Hatim and Mr. Arun came forward with their known contacts for additional quotes
9. We are planning to keep meeting on Sat 1st Oct 9 pm in Community Hall, for additional members to come forward with contacts
10. Request residents to please come forward and take active participation

would you advice legal opinion on this matter .can society force the owners of flats to Contribute 50% share of Rs.20 lakhs as per the act of MCHS

Thanks in advance for your immediate answer
