MENTIONING OF MATTERS

 

Hi folks, 

Years ago (2005) I argued a case b4 Jus Markandey Katju, wherein i cited a judgment, the sum and substance of which runs as follows.

" A judge normally deals with arguments that are emphasised/advanced during the hearing and not all that is narrated in the pleadings. However if there is any point that was argued which was left-out in the decision, it is the duty of the counsel to mention the matter b4 the judge, when the matter is still fresh in the memory of the judge".

If my memory is right it is a judgment of Justice Katju (CJ) of Madras High Court, who relied on a judgment of the SC.

As I am in need of the said judgment to challenge the dismissal of the case challenging the conferment of Padma Awards 2010.

Can anyone locate the said judgment for me ?
