Mediation at lok adalat

How can a wife approach lok adalat for mediation?

Quick Summary
This discussion clarifies how a wife can pursue mediation through Lok Adalat. If a case is already in family court, she can request a referral to the Legal Services Authority. Alternatively, for cases not yet filed, she can submit a pre-litigation conciliation petition directly to the Legal Services Authority. A simple application is sufficient, as no specific format is mandated. It's important to note the distinction between Lok Adalat, governed by the Legal Services Authority Act, and mediation under the Code of Civil Procedure.

She has to request the family court to refer the case to Legal Services Authority or if the case is not filed approach Legal Services Authority, with a Prelitigation conciliation petition.

If the case is pending, you may request the concerned Court. Else, you may file an application to the concerned Legal Service Authority.

A simple applicatopn will serve the purpose. There is no format prescribed.

Please appreciate the fact that Lok Adalat is different to Mediation, as Lok Adalat is governed by Chapter VI Section 19 to 22 of Legal Services Authorty Act, 1987, whereas mediation being an alternated disputes redressal system under Section 89 of the Code of Civil Procedure, 1908, be clear which one do you prefer.
