Making of trust

A has a House as personal property. He has established a mandir in a room in his house. He made a will and made a man B his heire, gaddidhar and owner of his house and mandir. In second appeal High Court made a trust of the house and Mandir. High Court did not accept B as owner and heir. Can the Court establish a trust for which any party had not pleaded?
