Maintainable of Title Suit aginst Defendant not in possessio

Plaintiff filed Declaration of  Title to Property aginst Defendant who is not in possession of the property and not in position to deliver the property: Can such suit be maintainable?

Yes. Plaintiff can file a suit for declartion of title against a person who challenges his title. To file such suit, it is not necessary that defendant must be in possession.
