Maintainability of a case and hearing the case on merits

Hello. I would appreciateif anyone can help me with a Supreme Court citation which lays down that Maintainability of a case and hearing the case on Merits are two different things.

In other words, "hearing an appeal/case on merits" excludes or does not involve the quetion of maintainability.
