Our apartment registered under Maharashtra Apartment Ownership Act. Developer executed deed of declaration and same has been registered with the competent authority. On the basis of a deed of declaration, the competent authority made the changes in property card and issued 7/12 on name of apartment.
Now question is
- Whether can we say that the property is fully transferred from the developer if 7/12 is on the name of apartment?
- In such situations, developer can claim his rights in future on “land” of the apartment?
- To prove the ownership of land is deed of apartment is necessary?
