My Parents met with a road accident on 04 June 2015. My parents were in the car. Our Lawyer advised us that two seperate claims have to be filed in MACT court for injury and damages to the Vehicle. First he filed claim for injury and we had been sent to meaditiaon centre where the claim was settled for Rs. 25K from Insurance Company against injury. The judge in the meadiation centre also confimed that a seperate claim has to be filed for loss to the Vehicle.
We thought that if the judge in meadiation centre had confirmed the advise from our lawyer then it should have been in line with the law. Now our lawyer has not filed the second case till date and he keeps saying that he has been quite occupied in some other matter and he will definitely file the second case.
Please advise on the following:
a) Was his advise for filing two seperate claims correct ?
b) Secondly, can second claim be filed even after almost 11 months from the date of accident ?
c) Will court entertain the second claim, given that the previous claim had been settled ?
