Limitation

Dear All, In a Sunni hanafi family, After the death of Father property was divided among brothers and sisters. While making a partition deed in 1976 for properties among themselves, In one Survey number there was 18 Acres of land belonging to the father, which came to share of younger brother, but instead of 18 acres only 14 acres was registered in the name of younger brother in the partition deed, As all parties themselves were not aware that total extent of land is 18 Acres in that survey number, Question: In 1995 the younger brother sold his share of land to a Builder, But instead of selling his 14 acres of land which he was entitled to, he sold the whole 18 acres of land by doing some fraud without taking signatures of other brothers and sisters for extra 4 acres of land, Now we want to file a suit against the builder and the younger brother to recover our 4 acres land which was in our fathers name, Since it is almost 20 years now since he sold the land to the builder but the land land is still with the same builder and it is still a open land no other interest has been created apart from the builder who purchased, Any delay will come in our way for filing a suit for partition and possession. Regards Renuka
