Liability in case of natural calamity

Dear Experts,

Greetings for the Day!

Pls. help me to clear my doubts in the following matter:

1) If a Deed of Declaration is executed u/s 2 (a) of the Maharashtra Apartment Ownership Act, it is not necessary to establish a soc. & it is not mandatory on a builder to handover the land & building to the society.

Is it correct?

2) In case of natural calamities who is responsible, if the building/s is/are destroyed? Is it the liability of the Builder to reconstruct the same? or is it the respeonsibility of association or society?

3) After formation of association, is builder having any rights in the Land?

Pls. calrify on this, as I'm getting confused.Is there any section for the said provision in MAOA?
