Legal notice delivery through coutier

If the Postal services are repeatedly not available due to Server non-Functioning, can legal notice in Sec 138 NI Act case be sent through Courier, since the Limitation is imp and days are passing yet postal services have not resumed services since a week.

Yes,legal notice in cheque bouncing matter can be sent through courier service and it will be deemed legal and valid provided submission of delivery receipt.

A legal demand notice under Section 138 of the NI Act can be issued by courier service, as it's considered a valid and effective mode of service, with high courts affirming its legality for complying with the Act's requirements. While sending a notice by Registered Post Acknowledgement Due (RPAD) is a preferred method for proof of service, courier services are acceptable, and proof of dispatch and tracking is crucial for the complainant to establish proper service of the notice on the cheque drawer.

Yes, it is acceptable, however, you will have to file PoD i.e., proof of delivery.

Why corrier service ? You can send it through whatsapp also.

If you're wondering whether you can send a legal notice via WhatsApp or email, the answer is yes—under certain conditions. 

The traditional means of sending legal notices through registered post or courier is still prevalent, but Indian courts are slowly and gradually accepting WhatsApp and email as communication methods in valid applications as long as there is evidence that such notices have been received and duly read.

For example, in the case between Kross Television India Pvt. Ltd. and Vikhyat Chitra Production, it was confirmed by the Bombay High Court that a valid service via WhatsApp comprising double ticks which implies delivery and seen could prove authentic.

 Likewise, it states in CLB v. National Spot Exchange Ltd. that the email notice could as well be taken as valid if evidence proved that it reached the recipient.
