Lease Deed-Renewal of-

       Dear learned friends, my clients' father , aged 78 years , had entered into an agreement of lease for 30 years with an educational society  thereby leasing out the 3000 sq.ft of land which was then minor property and the lease period will come to an end in June 2008.Now, the educational society intends to renew  the lease. My clients now attain majority and refuse for the same. Is there anything in law which authorize such renewal under the the guise of equity?

Dear Sundarraman, Since the lease was for 30 years, the decision to renew the lease for the further period depends upon the owner of the property..Generally there is clause in the lease deed that the lease will be renewed by mutual consent. If there is no clause for renewal of lease in the lease deed then the Leasee cannnot insist for the renewal of the lease deed. However the final decision rest with the Leasor whether to renew the lease for the further period or not. Hope this clarifies your query. Thanks umesh kapoor
