nowadays, most of the banks have gone for interview based appointments to the post of Law Manager.

 

few do take exam for the post of law officer.

 

main area of emhasis would be Labour Law, Commercial Law (contracts, SARFASI Act etc.) and Service Law.

thank u k.k. sir,recently UBI bank recruit specialist officers' post where written exam is requir & i don't know about the law paper which will objective.if u know about this plz help me but there is Job description is-"Documentation, Title Scrutiny, attending Court matters & DRTs, work related to Securitisation & Reconstruction of Financial Assets & Enforcement of Security Interest Act (SARFESIA) HAVING KNOWLEDGE OF Civil / Criminal Procedures with special reference to Banking, Arbitration matters, etc."plz sir give me suggestion which topic & Acts i should read.

REGARDING YOUR EXAMS KINDLY NOTE THAT

1.BANKS ARE GENERALY DEALING WITH BORROWERS AND DEPOSITORS.HENCE DOCUMENTATION WILL BE LOAN APPLICATION,MORTGAGE OF LAND,HOUSE PROPERTY ,AGREEMENTS FOR LOAN AND REPAYMENTS.

2.YOU HAVE TO DRAFT LOAN APPLICATION FORMS TERMS AND CONDITIONS AS PER PREVAILING LAWS.CHECH TITLE OF PROPERTY MORTGAGED AND GIVE SEARCH REPORT REGARDING CLEAR TITLE OF THE PROPERTY. REGARDING LAND MORTGAGED TO THE BANK BY THE BORROWER OF LOAN YOU HAVE TO CHECH THE TITLE OF LAND AT COLLECTORS OFFICE FOR PAST 15 YEARS TO 30 YEARS AS PER THE POLICY OF BANK. AND CHECK THE LAND RECORDS AND THE TITLE IS IN THE NAME OF THE BORROWER OF LOAN. KINDLY NOTE THAT OFFICIAL CHARGES OF RS.25/- PER YEAR YOU HAVE TO PAY AT COLLECTORS OFFICE AND THEN YOU WIILL GET OFFICIAL RECEIPT AND PERMISSION TO CHECK THE RECORDS .YOU SHOULD CHECK IT PERSONALLY ,IT TAKES ABOUT 2,3 DAYS TO PHYSICALLY CHECK THE RECORDS OF 15 TO 30 YEARS TO BE PERFECT .YOU ARE RESPONSIBLE FOR ANY MISTAKE HENCE YOU SHOULD CHECK IT PERSONALLY.DO NOT GIVE ANY SEARCH REPORT BLINDLY WITHOUT CHECKING RECORDS AS BORROWERS ARE VERY SMART PERSONS AND MAY TRY TO INDUCE YOU.KINDLY NOTE THAT BANK ARE RELYING ON YOUR REPORT AND SANCTIONING LOANS .IT IS YOUR RESPONSIBILITY FOR ANY FUTURE PROBLEM IN THE TITLE OF PROPERTY KINDLY NOTE.

4.REGARDING DEBTS RECOVERY TRIBUNAL PROCEDURE KINDLY NOTE THAT DISPUTED MATTERS WHERE LOAN ARREARS ARE MORE THAN 10 LAKHS ARE REFERED TO DRT.BY THE BANKS. KINDLY NOTE THE ACT IS SECURITISATION ACT.AS MENTIONED BY YOU ,KINDLY PURCHASE BARE ACT OF THE SAME YOU WILL GET PROCEDURE.IN BRIEF.BANKS MUST SEND NOTICE UNDER SAID ACT OF 60 DAYS TO THE BORROWER MENTIONING THE DATE OF LOAN ,INTEREST DUE AND TOTAL AMOUNT ARREARS.IT IS DEMANDED AND BORROWER IS DIRECTED TO SETTLE DUES WITHIN 60 DAYS ORELSE HIS MORTGAGED PROPERTY IS ATTACHED. AFTER 60 DAYS PERIOD IS OVER HIS PROPERTY IS ATTACHED AND ANOTHER NOTICE FOR SALE OF SAID PROPERY OF 45 DAYS IS SENT TO THE BORROWER.IN CASE THE ARREARS ARE NOT CLEARED THEN THE SAID ATTACHED PROPERTY IS SOLD ANDBANK LOAN  DUES WILL BE RECOVERED BY THE BANK.PLEASE NOTE

5 CIVIL AND CRIMINAL COURT PRACTICE AS ADVOCATE.IT INCLUDES FILING CASES ON BEHALF OF BANK. CIVIL SUITS FOR RECOVERY OF LOAN IN CIVIL COURTS AND CRIMINAL CASES UNDER SECTION 138 OF NEGOTIABLE INSTRUMENTS ACT FOR DISHONOUR OF CHEQUES ISSUED BY BORROWERS OF LOAN OR ANY OTHER TRANSACTION WITH THE BANK.
