land mutation

         i have a agriculture land which was my mother & uncle name .my mother has expired . now i want to enter my & my family name to replace my mother's name mutation.but my uncle objection for enter to name . already suit for partion between my mother and uncle was pending in revenue board.so i want to know that not will be enter name through fotetgi mutation .my uncle right to stay for mutation.tell me ur view
