I have a small query. our company is into constuction of national highways. we started constructing road from year 2006 and we are expecting final commercial operations date certificate in feb 2012.
My question is
Labour cess came in to effect from 1996. But in the state of UP, where we are constructing road, the Act came into effect from 2009.
Our total construction cost from 2006 to till date be Rs X
Our total constructon cost from 2006 to 2009 (i.e, date from which Act came in to force) be Rs Y
Is the labour cess @1% of total construction cost is applicable on Rs. X (I.e retrospectively)
or
Is it applicable on Rs (X-Y)
