Your guess is as good as anyone's...

 

SC gave one order, Hon Mumbai HC came with some interpretation of the same, and unfortunately that interpretation is not yet overruled by either the higher bench of Mumbai HC or by SC. So all the lower courts under Mumbai HC are bound to follow what Mumabi HC stated, but for all other courts its the presiding officer's wisdom....yes it is like that only....

 

Let me tell you one thing....our SC has miserably failed in enforcing something called "value of precedent"..........We follow the fundamental questionable practice that everything must be settled at the trial court after analysing evidences, even if the similar matter is settled hundreds of the time by SC/HC.......
