Hi

Under the Civil law,what is  the time frame for the judgement debtor to abide the judgement in case of not expressly mentioned the time period? and what provision goverened under such circimstances?

Limitation for enforcement of decree is 12 years as pointed out above. However, if the decree holder wish to enforce the decree against the judgmewnt debtor, he need not wait for 12 years and the court would enforce the decree against the judgment debtors as per its judgment once the decree holder put in an application for enforcement of the decree.

Dear Tenzin,

Limitation for execution of any decree of  a civil court is 12 years except a decree for mandatory injunction in which case it is 3 years.

Question is with regard to the JDR complying with the decree.

It is till the time the DH files EP proceedings which can be any time within 12 years.

i hope that Limitation is wrongly understood by others. Waiting for the lapse of 12 years means lapse of judgment. For enforcement of decree is 12 years, it has to be proceeded further within 12 years. clear to all ?

further, Limitation means nothing but maximum period and not minimum period.
