Judge not willing to give adjournment - what to do?

Plaintiffs cross will be completed by 15/04/2013.

  •  

My client/defendant has a genuine difficulty - she lives overseas, there is nobody to look after her young children and so cannot be present for her cross-examination until 12th June (when her husband will return from his travel).

Courts are closed for 1 month from 11th May to 9th June.

Will the judge close the evidence and proceed despite our request? How do I tackle this? Should I make an application for adjournment and then take to high court for appeal?

I am making a writ petition - let's see what happens. Will take it to High Court if judge dismisses it.
