This discussion explores the concept of a false 498A case, particularly when allegations are unfounded. It highlights the importance of presenting evidence during police investigation and filing a protest petition for re-investigation if the police fail to consider your proofs. The legal position is that a case is not considered false unless proven otherwise, and while re-investigation is typically a Magistrate's prerogative after a chargesheet, accused individuals can request it under certain conditions.
in my 498a case also I was not even called once for investigation, IO only called after 2 months saying chargesheet is filed and chargesheet has no medical evdience, and there are statement for 8 relatives, statement is just copy paste of FIR, if he would have done proper investigation, he would not have filed chargesheet also.. is there a way we can re order investigation?
