There is excution proceeding as well as misc.case u/o 9 rule 13 cpc(as case counter case) and is pending for hearing in the meantime the decree holder files a petition for withdrawl u/o 23 rule 1 cpc in excution proceding and same by petitioner/judt.debtor in misc case..is it maintainable..???
