Me n my wife are living seperately from last 4 years and DV act , section 9 n divorce case is going on ., she is living in foreign country n working there .now both parties are ready for mutual divorve ..will judge in district court admit our applicayion if we need to get divorce in onr week itself instead of 6 months between 1st n 2nd motion
Yes that is possible now in India, if there is a exceptional case. One party is living outside India and cannot come back after 6 months waiting period due to other preoccupations in the foreign country is good ground to convince the Family Court judge to allow the condonation of 6 months waiting period and allow the second motion in a week's time.
