Is agreement to sell against Court order?

If an owner of property enters into an agreement to sell to a third party whilst Court interim order restraining owner from alienation is in force on agreed date of sale, can third party sue for specific performance? Or is it against public policy as in section 23 of Indian Contract Act? Thank you for your assistance.
