Is Advocacy a REAL PROFESSION? How is this existing?

Samudreji, Our Part III of Constitution guaranteeing the Fundamental Rights to all citizens is based on the Bill of Rights of the American Constitution. Our Draft Constitution just like 2nd Amendment of US Constitution had the Right to Keep and Bear Arms explicitly enumerated. But for some reasons the explicit guarantee was removed, but the reference to it under Article 19(1)b was kept. I am reviving this thread to remind you that your threads in the past,such as this one,were very very impressive,where you always gave a thought to the common man's woes in India.

 

However,now you have stopped focussing on real legal and and social issues but are only talking of controversial issues like religions.

 

It's my appeal to you to restart writing on social isues,legal issues etc that are currently plaguing India,alongwith solutions to them,that you always provided,that made your threads commendable and worth reading.

 

Hoping to look forward to quality posts from you again..

Arupji thank you for appreciating the discussion. I have said what I had to say, if anything is left or more needs to be discussed it may be expressed. I will try to answer it.

IN IT'S HIGHER STAGE, advocacy is a very complex matter.

generally we discuss in a very lower level, where law is straight and simple.

in it's higher stage one may find that all the laws are like a banyan tree. 

it seems like one and single.  original tree can not be traced out.

doing justice and doing advocacy have some diffrence.

doing justice is the duty of the ruler - whoever it may be,- either democratic or something other.

advocacy is the art and lawbased presentation of the client's plea before the justice.

both are diffrent job but based on law.

mr ram samudre's thinking not very wrong. sometimes judges accept bribes from advocates - which is corruption.

it can not be seen very clearly but it is there.

it is also a perfect idea that - why a person have to pay a huge, while just to a person is free and to be delivered immediately.

Democartic Indian's posts all bear the stamp of high level of integrity and  knwoledge base.  His posts are cool, non judgemental, issue and knowledge based and do not carry an iota of gossip element. LCI should be very proud to have him as its member.

• In the cases which are filed by the Government it should be the responsibility of the Government to provide legal aid / service to all against whom it has filed the cases. 

 

• In the cases wherein the Government is not a party the responsibility to provide defence Lawyer / Advocate to the opposition should be lied upon the claimant and finally upon the looser.

 

• BUT, the Advocate / Legal aid should be provided by the Government.

 

• The Advocates / Lawyer should be under PUBLIC SERVICE registered with the Government on the basis of some PAYMENT OF WAGES REGULATION alike.

 

• The citizens should apply to Government to provide an Advocate / Legal Aid and accordingly should deposit the wages to the Government and the Advocate / Lawyer should be paid by the Government. 

 

• NO DIRECT TRANSACTION SHOULD BE BETWEEN ADVOCATE / LAWYER AS THE PUBLIC SERVANT.  NO PRIVATE ADVOCATE SHOULD BE ALLOWED OFFICIALLY TO BE APPEAR BEFORE COURT.

 

• ONLY, In the Business Matters the Private Advocate should be allowed, however, there should be some regulation for transactions through public service.

 

• PAYER SHOULD BE THE MASTER AND SERVER SHOULD BE RESPONSIBLE LEGALLY.

• Why the Court proceedings are such difficult so that a poor common man is made helpless and away from seeking justice ?

 

• Why the justice denied on technical grounds ?

 

• The mass people those are struggling for one time bread in a day why they are kept away from getting justice without any role of money ?

 

• Why the judicial system is made in which the common men cannot represent their case in a one-time one-day hearing in equally simple proceedings without hiring an advocate ?

• WE HAVE TO REACH TO A JUDICIAL SYSTEM FREE FROM ANY ADVOCATE OR MEDIATOR.

People of Democratic India ever have the Right To Information as a part of their Democratic Rights.  But, the Bureaucrats have broken it under a false shelter of Official Secret Act 1923 which was actually gone died on 26 January 1950.  Therefore, now the RTI Act 2005 come into existence to penalize the public servants who deny information to any citizen within time frame and for its mean every citizen can have all the information within their individual capacity whatever the information a Legislative Assembly or Parliament can call.

 

Is there feasibility for “RIGHT TO JUSTICE ACT” like “RTI Act 2005” to penalise the judges (Public Servants) who do not provide justice (decision) within a time frame???

Meenal ji, Arup ji and Ambika ji,

Now I don’t feel a need to be more on this site as the work is already done here. That’s why I was not re-opening my ID after earlier ban. But I cannot dishonour your words so re-registered. OK ! will try the suggested. But in case of one more ban, I will not come here again, as I said, our work is already done here successfully.  We never be disturbed by anyone since e never mind any anti-force. My friends pl always remember my quote;
