ipc 419,420,120B and 224

one of my friend was caught on examination gate for impersonation in exam but he escaped..after 1 hour he again caught..during this he was seriously injured and his right hand finger is broken..Now he admitted in government hospital in police supervision..Now our advocate told us that until police hand over the accused from police custody to judicial custody..bail is not possile..is it right.? i want ur opinion regarding this.

you didn't disclose that whether a FIR has been registered for this or not?

It could be that there is no formal arrest so far. There is no urgency for the police to arrest him so long as he is hospitalised. Once arrested, the accused needs to be produced before the Magistrate within 24 hours. Some among the alleged offences could be non-bailable; only the Court can grant him bail.

It is serious allegation/ offence and it is better to seek advise/ guidance of a local prudent lawyer with relevant case file for better appreciation of facts and proceeding.
