Ilyas,
You have to defend yourself, as punishment u/s 353 is max 2 yrs jail if proved,
If the officer was not on duty, or not acted in discharge of his duty, it will attacrt only s 352 [3 month]
Opp Party is public servant , and court takes it seriously. Engage a Cr. Advocate of repute.
