There was an incident in our village. Some boys having TATA safari ruins three-four peoples and run away. During this, sufferer file a FIR against those person, but also targeted few person which were not in the scene. The incident was taken place at 11 in the night. Now the police has arrested the person who was not involved in the case, also verification from DSP and SHO indicates tht the person was not in the scene. Now he is under custody. The charge is IPC 307. What are the possibilities of his bail as main accused were not caught till date. Also can he file petition against the false case on him. What are the possibilities. Also all the person involve in the incident was run away and police has inquired him in the night near about 1 AM. If he was there really then there are chances tht he would not be captured on tht night,
Please guide me so tht I can stop an unjustice to the person.
