INTERIM RELIEF IN ARBITRATION PROCEEDINGS

A settlement agreement that I signed by one of my ex employers has been referred to Arbitration and an Arbitrator appointed by the Chief Justice of Allahabad High Court . In accordance with settlement agreement, I have to receive a substantial money from my ex-employer . Can I apply to/petition the Allahabad High Court to protect my financial interest by attaching the property of the ex-employer or directing that a fixed deposit be made with Court's lien or else the disputed amounts agreed to be paid under the settlement agreement be deposited with a Court pending completion of arbitration proceedings and publication of Award ?

Dear Mr.Arun,

If the Arbitration proceedings are pending then you under Section 9 of Arbitration & Conciliation Act, 1996 can approach the Arbitral Tribunal otherwise if the Award is being given then you seek execution of the same.

Best Regards

Daksh
