Interest on crpus fund

Hi,

We are a complex of five societies. We are now in the process of registering the Association of Societies. The Builder have been stating that he would not be paying interest on the corpus fund having stated so in sale deed (agreement). Its more than 4-5 years that the corpus fund is with them. We are afraid, they would not be paying us whole of the corpus funds. I am of the opinion that the Corpus fund must remain untouched & moreover the builder must add the acruued interest to Funds.

What are the legal options for us in such a scenerio ?

1) Some of our members have already fined a ciivl suit against the builder for another reason, the builder is trying to construct a building on a place earmarked for garden. can the association join the case & also add this point of corpus fund in that ? Is it possible that we take whatever funds they give & then file a case ?

2) File a seperate civil suit .

3) Go to consumer court. But they take a long time to react.
