Injunction order against father and mother

Page no : 2

ravi yudha (ceo, non-profit org)     24 August 2020

Venu sir, I am not a lawyer, if so I would have given my suggestion. Also you are not a judge, you are an advocate.

Are you saying that his wife's parents are right in staying in his wife's home and not vacating and giving mental torture?

People come to a conclusion that aged persons are always right. Which is not true. Good and Bad people exist in all ages.

Same with parents. Not all parents are true to all children. They exhibit partiality and favour certain children.

Example... In many cases sons are favoured over daughters, mother favours eldest son, father favours youngest sons. THese things happen in our society.

I suggest you drop your prejudiced mind and look at presented facts only.

Sudhir Kumar, Advocate (Advocate)     24 August 2020

Even if, Mr Venu can form an opinion and has a solution still on this charitable forum he is not bound to express.

Further for getting a legal view, one has to give facts, which in this case are coming in installment.

Given facts do not in any way show his wife and he himself (including major children) could seek exemption from liability under Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

The eviction is not going to be a smooth sail, even if the house is in wife's name and even if the house is sold.

But they cannot (atleast as per facts shown so far), compel his wife to transfer property in the name of whomsoever they want.  The right to maintenance under the said Act also does not extend to right to torture.

If someone does not want to give advice, they should just keep quiet, they should not bother to accuse the person of lying and telling stories. How does Venu sir know whether or not this person is lying other than prejudice?

Sudhir Kumar, Advocate (Advocate)     25 August 2020

when someone tells half truth then he is lying.

The guidance in the forum is not exclusively dedicated to a single queriest alone, and such guidance should educate or spread awareness to all those concerned with the same issue now or in the future.  Perceptions differ and those who have secured more than 50,000 points are super experts in their field.  There is no mandate or compulsion to take guidance.  Either it can be taken or forgotten but the experts have a right to state their opinion even if it may not taste to the queriest.  At the end in this respectable forum,  decency and respecting each other irrespective of different opinions is desirable.

Yes in a respectable forum, calling someone a liar when no one knows the truth is ridiculous.

Qualified people will not do that.

Sudhir Kumar, Advocate (Advocate)     25 August 2020

full facts were not disclosed in earliest query.

Anyway, it is discretion of Mr Venu to give or not to give his views in charity.

Dr J C Vashista (Advocate)     26 August 2020

If you are not able to vacate them, and also you are unable to remit the emi, better issue sale notice, negotiate with the prospective buyer who will deal with vacating and take charge instead of going in for litigation.
