Gopal Krishna Behera (Advocate Orissa High Court Cuttack.)     05 February 2011

Inherent Power of the High Court- Quashing of Proceeding.

Law as settled, permits the High Court to quash a criminal proceeding between the husband and wife as well as other in-laws if the interest of justice so demands, to bring peace and harmony in the life of the wife as well as husband when they them selves state that they resolved their disputes and living peacefully.  Such quashing of criminal proceeding can be done by exercise of the inherent power under section 482 of the CR.P.C.
