we are a primary cooperative society registered under Rajasthan cooperative Society Act working with 5 employees with an aim to upliftment of members. We collect and deposit money from members and give loan/ money to other needy member only. Recently we have terminated 2 employees from service. Our byelaws allows Board of directors to recruit or terminate the employees .These employees complaint for their termination to cooperative department but cooperative department was agreed upon society decision. Then they filed suit in civil Court whereas the case was dismissed and instructed  employees to suit file at appropriate court. Now these two employees filed case in labour court. We wish to raise our premilarinary and STRONG objection that cooperative societies who employees less than 10 employees is not an “INDUSTRY”  u/s 2(j) and  not covered under ID act so that this case is  in not maintable in this act.

please tell us is sec 2(j) is notified yet and exemption of this section is available to us.
